These Terms & Conditions define the rules for using the DЇVNA online store available at https://divna-official.com.
By placing an order in the Store, you accept these Terms & Conditions and the Privacy Policy.
§1 Basic Definitions
Online Store (Store) – website available at https://divna-official.com.

Customer – a natural person, legal entity or organizational unit that has concluded or intends to conclude a sales agreement with the Seller.
Consumer – a natural person making a legal transaction not directly related to their business or professional activity.
Goods – movable products offered in the Store, in particular nail styling products.
Sales Agreement – agreement concluded between the Customer and the Seller through the Store.
Order – Customer’s declaration specifying the product, quantity, payment method and delivery method.
Business Day – Monday to Friday, excluding public holidays.
§2 General Provisions
- The Store conducts retail and wholesale sales in Poland and selected EU countries.
- Placing an order means acceptance of these Terms & Conditions and the Privacy Policy.
- Customers’ personal data is processed in accordance with GDPR.
- All Goods are legally placed on the Polish market.
- These Terms & Conditions are available free of charge on the Store website.
§3 Terms of Service
- The Store provides electronic services enabling the conclusion of sales agreements.
- Placing an order requires reading and accepting these Terms & Conditions.
- Using the Store is free of charge. The Customer only bears the cost of Internet access.
§4 Contract Conclusion
- To conclude a sales agreement, the Customer selects Goods and completes the order form.
- The sales agreement is concluded when the Seller confirms acceptance of the order.
- Product information constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Polish Civil Code.
§5 Order Processing
- Orders are processed in the order in which they are received.
- Processing time is 1–5 business days, unless otherwise stated on the product page.
- In case of delays, the Seller will inform the Customer as soon as possible.
§6 Delivery
- Delivery is carried out via InPost Parcel Lockers, InPost Courier and other available courier companies.
- Delivery costs are displayed during checkout.
- Free delivery within Poland applies to orders above 250 PLN gross.

§7 Payment Methods
- Secure online payments are available through the Przelewy24 payment operator.
- Available payment methods may include BLIK, online bank transfers, payment cards and other methods available in Przelewy24.
- The order is processed after payment confirmation by the payment operator.

Processing time: usually instant. The order is processed once payment is confirmed by the operator.
§8 Warranty Liability
- The Seller is responsible for the conformity of Goods with the agreement in accordance with applicable law.
- Liability lasts for 2 years from the date the Goods are delivered.
- Complaints should be submitted in writing or by email.
- The Seller responds within 14 days of receiving the complaint.
§9 Right of Withdrawal
- The Consumer has the right to withdraw from the agreement within 14 calendar days without giving any reason.
- The withdrawal period starts from the day the Goods are received.
- The withdrawal statement should be sent by email or post.
- The Seller refunds payments within 14 days of receiving the withdrawal statement.
- The refund is made using the same payment method, unless otherwise agreed.
- The Customer bears the cost of returning the Goods.
- The right of withdrawal does not apply to sealed products after opening, custom-made products or products with a short shelf life.
- The Goods should be returned in their original packaging and in intact condition.
Proof of purchase
A return or complaint is possible upon presenting proof of purchase: receipt, invoice, payment confirmation or other proof of purchase.
§9a B2B Orders (VAT Invoice)
- The 14-day right of withdrawal applies only to Consumers.
- For B2B purchases with a VAT invoice, the right of withdrawal does not apply unless applicable law states otherwise.
- Returns of products purchased by business customers are not accepted unless agreed individually.
- An exception applies to sole proprietors making purchases not professionally related to the nature of their business, in accordance with Article 38a of the Polish Consumer Rights Act.
§10 Failure to Collect Shipment
- If the Customer does not collect the shipment, the Store may charge the Customer for shipping and return costs.
- If the order qualified for free delivery, the Customer covers the actual shipping and return costs.
- Resending the order may depend on payment of these costs.
- If payment is refused, the Store may pursue the costs in accordance with applicable law.
§11 Complaints
- Complaints should be sent to: info@divna-official.com
- The Store reviews complaints within 14 days of receiving them.
- The complaint should include the order number, description of the problem and photos if needed to review the case.
§11a Shipping Damage
- The Customer is required to inspect the shipment upon delivery.
- In case of damage, a damage report should be prepared.
- For Consumers, the Store is responsible for the shipment.
- For B2B VAT invoice purchases, responsibility passes to the Customer when the shipment is handed over to the courier company.
- All shipments are covered by basic insurance according to the courier company’s terms.
- The Customer may purchase additional shipment insurance.
- Lack of a damage report may prevent a complaint from being accepted.
- The shipment is insured; however, transport-related damage or loss should be reported according to the complaint procedure of the courier company.
§12 Out-of-Court Dispute Resolution
The Consumer may use mediation or arbitration through the Trade Inspection and the ODR platform: https://ec.europa.eu/consumers/odr.
§13 Newsletter & Marketing
- The Store may offer a newsletter containing information about products, new arrivals and promotions.
- Newsletter subscription is voluntary and free of charge.
- The Customer may unsubscribe at any time.
- The Seller may process data to personalize marketing content, without legal effects for the Customer.
§14 Business Customer Provisions (B2B)
- In relations with business customers, warranty liability may be excluded to the extent permitted by applicable law.
- Disputes are resolved by the court competent for the Seller’s registered address.
§15 Personal Data Protection
- The controller of personal data is Viktor Kurylenko, email: info@divna-official.com.
- Personal data may be shared with entities cooperating with the Store in order fulfillment, including courier companies, payment operators, hosting providers and accounting services.
- The Customer has the right to access, correct, delete or restrict the processing of data and to object to processing.
- The Customer has the right to lodge a complaint with the President of the Personal Data Protection Office.

§16 Force Majeure
The Seller is not responsible for non-performance or delay caused by force majeure, including system failures, natural disasters, strikes, pandemics or other events beyond the Seller’s control.
§17 Final Provisions
- Matters not regulated herein are governed by Polish law.
- In disputes with foreign customers, Polish law and the court competent for the Seller’s registered address apply.
- The Seller reserves the right to amend these Terms & Conditions.
- The sales agreement may be concluded in Polish or English, depending on the language version of the Store.
